Trusts: A Cornerstone of Estate Planning
Steve, can you tell us a bit about the different types of trusts and why they are so important in estate planning?
Certainly. Trusts are incredibly valuable tools that allow individuals to manage and distribute their assets according to their wishes. They provide flexibility, control, and often significant tax advantages.
Today, we’re going to focus on the Revocable Living Trust, which is the most common type of trust used in estate planning.
The Benefits of a Revocable Living Trust
A Revocable Living Trust allows the creator, known as the grantor, to maintain complete control over their assets during their lifetime. They can modify the terms of the trust, add or remove beneficiaries, and even dissolve it altogether if circumstances change.
Moreover, upon the grantor’s passing, the trust assets avoid probate, a time-consuming and often expensive legal process. This means that assets can be distributed to beneficiaries more quickly and privately.
According to the American Bar Association, approximately 60% of Americans over the age of 50 have not created a will or trust. Consequently, their assets are subject to probate upon their death.
Navigating Potential Challenges
Steve, have you encountered any challenges when helping clients establish Revocable Living Trusts?
Yes, occasionally we encounter situations where individuals haven’t fully grasped the importance of keeping their trust documents updated. Life changes – marriage, divorce, birth of children, or significant financial shifts – and it’s crucial that the trust reflects those changes to ensure assets are distributed according to the grantor’s current wishes.
I recall a case where a client had created a Revocable Living Trust years earlier but hadn’t updated it after her divorce. Consequently, upon her passing, a portion of her estate inadvertently went to her ex-husband. It was a heartbreaking situation that could have been easily avoided with periodic reviews and updates.
