Determining If Probate Is Necessary

Today, I’m speaking with Steve Bliss of Wildomar Probate Law about the crucial first step in estate planning: determining if probate is even necessary. Steve, can you walk us through this initial stage?

“Certainly,” says Steve. “Probate can be a complex and time-consuming process, so it’s important to figure out from the outset if it’s truly required.” He explains that the first step involves assessing the value of the deceased person’s estate. In California, probate is generally necessary if the estate exceeds $184,500.

Next, we need to identify any assets that are not subject to probate. These are often referred to as ‘non-probate assets’ and can include assets held in trust, jointly owned property with rights of survivorship, or certain retirement accounts with designated beneficiaries. Consequently, if the value of the probate estate falls below the threshold, or if a majority of assets are non-probate, then formal probate proceedings may be avoidable.

Steve emphasizes that this initial assessment is critical because it can save families significant time, expense, and emotional stress. “I’ve seen countless situations where families were prepared to embark on the full probate process only to discover that it wasn’t necessary. In those cases, we were able to guide them through a much simpler process of transferring assets directly to beneficiaries,” he explains.

He recalls one particular case involving a widowed mother whose husband had passed away. “The family was understandably overwhelmed with grief and the prospect of navigating probate seemed daunting. However, upon careful review, we determined that most of the husband’s assets were held in joint tenancy with his wife, effectively bypassing the need for probate altogether.

This allowed them to focus on healing and moving forward without the added burden of a lengthy legal process. It’s moments like these that remind me why this work is so important.”

Common Challenges

Steve acknowledges that even with careful planning, challenges can arise during the probate process. “Sometimes, there are disagreements among heirs regarding the distribution of assets. Or, there may be unexpected debts or legal claims against the estate that need to be addressed.”
