Certainly. Handling debts and taxes is a fundamental part of administering an estate. Ordinarily, it occurs after the probate court has issued Letters Testamentary or Letters of Administration, granting the executor or administrator authority to act on behalf of the deceased.

The first step involves meticulously identifying and compiling all outstanding debts owed by the decedent. This includes credit card bills, loans, medical expenses, and any other liabilities. It’s essential to be thorough in this process to avoid potential legal issues down the line.

Once all debts have been identified, we prioritize paying valid creditor claims. This is done according to a specific order outlined by California probate law. Secured creditors, those who hold collateral for their loans, are typically paid first. Subsequently, unsecured creditors are paid based on their claim priority.

Notwithstanding the debt repayment process, it’s crucial to simultaneously address tax obligations. The executor or administrator is responsible for filing and paying any federal and state estate taxes that may be due.

This phase can be complex and time-consuming. Consequently, I always recommend seeking guidance from an experienced probate attorney like myself.

I recall a case where the decedent had a significant amount of outstanding medical debt, which wasn’t immediately apparent. Had we not carefully reviewed all financial records, those debts could have potentially jeopardized the distribution to heirs.
