We then file this detailed inventory and appraisal with the court using specific forms like DE-160/161. This transparency is essential to ensure that all interested parties are informed about the assets involved in the probate process.
Moreover, during this stage, we often uncover hidden assets or forgotten accounts. It’s not uncommon for individuals to have investments or savings they’ve overlooked over time. It’s our responsibility as attorneys to diligently search for these assets and ensure they are properly accounted for in the estate.
While marshaling assets is a systematic process, there can be occasional challenges. For example, I once encountered a case where the deceased individual had numerous investment accounts spread across different institutions under various aliases. It took considerable detective work to track down all the holdings and consolidate them into a complete picture of their financial portfolio.
