Ted: “That’s a great question and one we hear often. Not every estate requires probate, thankfully. If the total value of assets is below a certain threshold ($184,500 in California) or if assets are held in ways that bypass probate – like joint tenancy or trusts – then probate might be avoidable.

But it’s always best to consult with an experienced attorney to determine the specific needs of each case.”

Ted: “Alright, let’s talk about filing the petition. This is the official document that kickstarts the probate process. We file a form called DE-111 with the county court. In this petition, we request the appointment of an executor or administrator – the person who will manage the estate – and also submit the original will if one exists.”
